In accordance with the 2nd article of the Law on Transformation of Areas Under the Risk of Catastrophe numbered 6306, risky areas are stated as “the areas decided by the Council of Ministers upon a request from the Ministry and opinion of the Disaster and Emergency Management Presidency by the Ministry of Environment and Urban or related Administration ”.
In this context, Izmir-Karabaglar by 2012/4048 numbered Council of Ministers’ decision on 31 December 2012, Bursa-Yıldırım, Mevlana, Ulus, Yavuzselim, Arabayatagı, Cınaronu, Hacivat and Sirinevler by 2012/4086 numbered decision, Bursa-Osmangazi / Akpınar by 2012/4087 numbered decision, Ankara-Altındag, Atıfbey, Hıdırlıktepe and Ismetpasa by 2012/4088 numbered decision, Istanbul-Sarıyer / Fatih Sultan Mehmet (Armutlu) by 2012/4125 numbered decision, Erzurum-Yakutiye/Mecidiye, Aziziye, Gaziler and Veyisefendi by 2012/4141 numbered decision on 26 January 2013 Istanbul-Gaziosmanpasa by 2012/4099 numbered decision, Ankara-Beypazarı-Ayvasık by 2013/4161, Trabzon-Merkez-Gurbulak-Guzelyalı by 2013/4228 numbered decision, Ankara-Mamak-Araplar/Derbent/Dostlar and Kostence by 2013/4232 numbered decision, Karaman-Merkez – Gevher Hatun/Tabduk Emre and Seyh Edebali by 2013/4236 numbered decision these areas stated as risky area.
Recently, Istanbul-Sarıyer/Camlıtepe(Derbent) is stated as risky area by the Council of Ministers on 3 January 2013 and published on the Official Gazette on 24 January 2013.
The upcoming process for owners and lesser of the buildings within the risky areas and decided to be demolished is as follows;
* Before commencing any implementation to demolish buildings, the owners of buildings are granted at least sixty days.
* In case a building is not demolished in this duration, related administration notifies that the building will be demolished and grants for another period.
* In case owners still do not demolish the building, evacuation and demolish is performed by local administration in corporation with other related administrations, and the expenses for demolish and evacuation shall be covered from the Transformation Projects’ special account.
* Ministry notifies the related administration about the buildings which are not demolished in time. These buildings are demolished by the Administration or have demolished by the Administration. If necessary Ministry may perform detection, evacuation and demolish processes itself.
Owners and renters of the buildings within the scope of risky area and decided to be demolished should take legal advice from the specialist especially in urban transformation and zone law to benefit most efficiently from the relieves granted in law and not to suffer from any loss.
